Terms, customer information, and withdrawal notice for BerlinCandles.

This terms page is the current website adaptation of the legal seller information used for BerlinCandles on Etsy. It remains a review-required draft for the public site and should be legally checked before the website relies on it as its final terms and conditions.

Scope of these terms

This website presents BerlinCandles and links customers to the BerlinCandles Etsy shop. Product purchases are currently concluded through Etsy. The product listing, checkout flow, and order details shown on Etsy form the decisive commercial basis for the purchase.

How a contract is formed

When a product is published on Etsy, the corresponding Etsy listing constitutes a binding offer to conclude a contract on the terms shown in that listing.

The contract is concluded through Etsy’s cart and checkout process when you submit the order through the corresponding order button. Before submitting the order, you can review, correct, or cancel the entries made in the checkout flow.

Order handling and contract-related information are typically sent by email and/or Etsy messages. You must make sure that the email address stored for your order is correct and that messages can be received.

Personalised products

For personalised products, you must provide the names, texts, messages, or other content required for customisation through the Etsy order flow or promptly after the contract is concluded.

You must not send content that infringes third-party rights or violates the law. You indemnify BerlinCandles against third-party claims arising from such material, including reasonable legal defence costs.

We do not review submitted content for correctness. If a proof or correction draft is sent to you, you must check it promptly and release it in text form if it is correct. We are not liable for errors that were not objected to before approval or production.

Prices and payment

The prices shown in the relevant Etsy listing are total prices. Because BerlinCandles operates under the small-business exemption, no VAT is shown separately on invoices pursuant to § 19 para. 1 UStG.

Shipping costs, if any, are shown separately in the Etsy listing or during checkout unless free shipping is expressly stated.

Payments are processed through Etsy’s secure payment environment. Etsy Gift Cards and Etsy Credits may be accepted where Etsy makes them available. According to Etsy, shops never receive your full credit card information.

Unless another payment arrangement is expressly stated, the payment claim is due immediately upon conclusion of the contract.

Delivery

Delivery conditions, delivery restrictions, and dispatch times are shown in the relevant Etsy listing.

Unless a different period is stated in the listing, goods are delivered within 3 to 5 days after the contract is concluded; in the case of advance payment, the period begins after the payment instruction has been made.

For consumers, the risk of accidental loss or deterioration passes only when the goods are delivered to the customer, unless the customer has commissioned a carrier independently.

Cancellations, returns, and exchanges

Cancellations are not accepted.

Return and exchange eligibility depends on the item details shown in the relevant Etsy listing. If you have any problems with your order, please contact BerlinCandles directly.

Withdrawal right for consumers

If you are a consumer, you generally have the right to withdraw from a contract for non-personalised goods within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which:

  • you, or a third party named by you who is not the carrier, took possession of the goods, if one or more goods were ordered in a single order and delivered together;
  • you, or a third party named by you who is not the carrier, took possession of the last goods, if several goods were ordered in a single order and delivered separately;
  • you, or a third party named by you who is not the carrier, took possession of the last partial shipment or the last item, if goods were delivered in several partial shipments or pieces.

To exercise the right of withdrawal, you must inform BerlinCandles by an unequivocal statement, for example by post or email:

To meet the withdrawal deadline, it is sufficient that you send the notification before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal. Additional costs resulting from a delivery method other than the least expensive standard delivery offered by us are not reimbursed.

We will use the same means of payment that you used for the original transaction unless something else was expressly agreed. No fees will be charged for the reimbursement.

We may refuse reimbursement until we have received the goods back or until you have supplied evidence that you have returned the goods, whichever occurs first.

You must send back or hand over the goods without undue delay and in any event no later than 14 days from the day on which you informed us of the withdrawal. The deadline is met if you send the goods before the 14-day period expires.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if that diminished value results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of the withdrawal right

The withdrawal right does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual choice or determination by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.

This applies in particular to personalised candles and custom-made products.

Warranty and retention of title

The statutory warranty rights apply.

The goods remain our property until full payment has been made.

Applicable law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the country of your habitual residence remain unaffected.

BerlinCandles is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
